These Terms of Use govern your access to and use of merchantic.io and its related pages and tools (the “Site”), operated by Merchantic Payments, LLC (“Merchantic,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Merchantic is an independent sales agent for multiple payment processors and financial institutions. Merchant accounts are provided by those processors and their sponsor banks, not by Merchantic, and are governed by the merchant processing agreement you sign with them. Those agreements, not these Terms, control the terms of any merchant account.
The Savings Calculator, Statement Analyzer sample profiles, revenue calculators, and similar tools produce estimates for illustration only, based on the figures you enter and general pricing assumptions. The API Sandbox returns simulated responses and does not process real transactions. None of these outputs is a quote, rate guarantee, or pricing commitment. Surcharge estimates do not determine whether a surcharge program is permitted for your business, card types, or state.
Nothing on the Site is an offer to provide merchant services. Every account is subject to underwriting review and approval by the applicable processor and sponsor bank, which may decline or condition any application at their discretion. Pricing is confirmed only in a signed agreement.
When you submit a form, statement, or application, you represent that the information is accurate and that you are authorized to provide it on behalf of the business. Please do not upload full card numbers or bank account numbers unless an application specifically requires them. Our handling of the information you submit is described in our Privacy Policy.
Residual percentages, tiers, and earnings examples on the Site are illustrative. Participation in the Referral Partner Program, and any compensation, is governed solely by a separate written agreement between you and Merchantic.
You agree not to misuse the Site, including by submitting false or fraudulent information, uploading malicious files, attempting to gain unauthorized access to our systems, interfering with the Site’s operation, or scraping or harvesting data from it by automated means.
The Site and its content, including text, design, graphics, logos, and software, are owned by Merchantic or its licensors and are protected by intellectual property laws. You may view and print pages for your own business evaluation. You may not copy, modify, or redistribute Site content without our written permission. Third-party names and marks belong to their respective owners.
The Site may link to or integrate with third-party websites and services, including scheduling, payment, and document tools. We do not control and are not responsible for their content, availability, or practices, and your use of them is subject to their own terms.
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Educational content on the Site is general information, not legal, tax, or financial advice.
To the fullest extent permitted by law, Merchantic will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or data, arising from your use of the Site or reliance on its content or tools, even if advised of the possibility of such damages.
You agree to indemnify and hold harmless Merchantic and its officers, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Utah, and you consent to their jurisdiction.
We may update these Terms from time to time. Changes take effect when posted on this page with a new revision date. Continued use of the Site after changes are posted means you accept the updated Terms.
